    Social media continues to be an employment law hot topic and a challenge for HR professionals to manage from a policy standpoint.   This session will provide HR professionals with a deeper understanding of two emerging trends in social media policy- Ownership Issues and Cyberscreening.  Molly dives into an analysis and strategic discussion of ownership & access issues between employers and their employees’ social media accounts.  Discussion involves case studies where the employee denies access to the employer, employer denies access to the employee and specific issues arising from employee use of LinkedIn.  In addition, she will discuss legal risks and strategies to avoid risks associated with cyberscreening, including: Google search of public information, requiring interviewees to log into facebook during an interview, password requirements and “friending” mandates.   Molly’s review of emerging case law, the developing key issues and examples of present legal risks with social media in the workplace will provide attendees with awareness and practical knowledge to reduce risk within our own organizations.

    Molly DiBianca is an attorney with the law firm of Young Conaway Stargatt and Taylor, LLP, in Wilmington, Delaware, where she practices employment law. Molly’s legal practice consists of equal parts litigation and client counseling in all facets of the employment and post-employment relationship. As part of her preventative-practices philosophy, Molly regularly provides in-house training to managers and supervisors. She speaks to national audiences about a variety of employment-law topics and, particularly, about the impact of social media and technology on the modern workplace. Molly writes and edits the Delaware Employment Law Blog, which was named one of the Top 100 Legal Blawgs in the country by the ABA in 2009 and 2010 and, in her free time, writes about the impact of social media on the legal profession on her second blog, Going Paperless Blog.
